The term "Customer", "you" or "your" refers to any person purchasing products through our website. 2. Scope and Acceptance of Terms These Terms and Conditions apply to all purchases made through the LA GRECQUE SARL-S online store. By placing an order, the Customer confirms that they have read, understood and accepted these Terms and Conditions before completing the purchase. These Terms apply together with the following documents: Privacy Policy; Cookie Policy; Returns & Right of Withdrawal Policy; and Shipping & Delivery Policy. These documents form part of the contractual relationship between LA GRECQUE SARL-S and the Customer. Nothing in these Terms limits any mandatory consumer rights granted under Luxembourg law or applicable European Union legislation. 3. Products LA GRECQUE SARL-S specialises in selected food products and related goods. We make every reasonable effort to ensure that product descriptions, photographs, prices and availability information are accurate. However, minor variations may occur due to: differences in screen display; packaging updates by producers; seasonal variations; artisanal production methods; or supplier changes. Such variations shall not constitute a defect where the product remains substantially consistent with its description. All products are subject to availability. Where a product becomes unavailable after an order has been placed, LA GRECQUE SARL-S will inform the Customer without undue delay and may offer: a replacement product of equivalent value; partial fulfilment of the order; cancellation of the unavailable item; or a refund of the unavailable item. 4. Product Information, Allergens and Storage Customers are responsible for reviewing product information before completing their purchase. Where applicable, product information may include: ingredients; allergens; nutritional information; storage instructions; product origin; and producer information. Customers with food allergies or intolerances should carefully review product information before consumption and may contact LA GRECQUE SARL-S before ordering if additional information is required. Customers must follow all storage instructions provided on product packaging. LA GRECQUE SARL-S shall not be responsible for deterioration caused by incorrect storage, handling or misuse of products after delivery. 5. Prices All prices displayed on the website are: expressed in Euro (€); inclusive of applicable VAT; and exclusive of delivery charges unless otherwise stated. Delivery costs are calculated and displayed before the Customer confirms the order. LA GRECQUE SARL-S reserves the right to change prices at any time. Price changes shall not affect orders already accepted by LA GRECQUE SARL-S. In the event of an obvious pricing error, LA GRECQUE SARL-S reserves the right to cancel the order and refund any payment already made. 6. Ordering Process The Customer places an order by completing the following steps: Step 1 – Product Selection The Customer selects products and adds them to the shopping cart. Step 2 – Order Review Before payment, the Customer may review and modify: selected products; quantities; delivery information; billing information; and payment details. The Customer is responsible for correcting any errors before submitting the order. Step 3 – Order Submission By clicking the order confirmation button, the Customer submits a binding purchase request. Before completing the order, the Customer must confirm: ☐ I have read and agree to the Terms & Conditions. ☐ I acknowledge that my personal data will be processed according to the Privacy Policy. Step 4 – Order Confirmation After submitting an order, the Customer receives an acknowledgement email confirming receipt of the order. This acknowledgement does not automatically constitute acceptance of the order. The sales contract becomes binding when: payment has been successfully authorised; product availability has been confirmed; and LA GRECQUE SARL-S confirms acceptance or dispatches the order. 7. Right to Refuse or Cancel Orders LA GRECQUE SARL-S reserves the right to refuse or cancel an order where: products are unavailable; there is an obvious pricing error; payment is refused; fraudulent activity is suspected; customer information is incomplete or inaccurate; misuse of promotional offers is identified; or fulfilment becomes impossible for legitimate reasons. If payment has already been received, any approved cancellation will result in a refund using the original payment method. 8. Payment Terms Payment must be made in full at the time of ordering unless another payment arrangement has been expressly agreed in writing. Available payment methods are displayed during checkout. Payments are processed securely through authorised payment service providers. LA GRECQUE SARL-S does not store complete payment card information. By submitting payment, the Customer confirms that: they are authorised to use the selected payment method; and all payment information provided is accurate. An order will not be accepted where payment authorisation fails. LA GRECQUE SARL-S may suspend or cancel an order where: payment is declined; fraud prevention checks fail; unauthorised payment is suspected; or the payment provider refuses the transaction. 9. Retention of Ownership Ownership of purchased goods remains with LA GRECQUE SARL-S until full payment of all amounts due has been received. This retention of ownership does not affect the transfer of risk applicable to consumers under mandatory law. 10. Delivery Delivery is currently available throughout Luxembourg. Customers wishing delivery outside Luxembourg should contact LA GRECQUE SARL-S before ordering. Delivery charges are displayed before payment confirmation. Orders are generally processed Monday to Friday, excluding Luxembourg public holidays. Orders are normally prepared for dispatch within: 1–2 business days after payment confirmation. Estimated delivery within Luxembourg: 2–5 business days after dispatch. Delivery times are estimates and may vary due to circumstances outside our control. 11. Transfer of Risk For consumers, responsibility for loss or damage transfers when the Customer, or a person designated by the Customer, receives physical possession of the goods. This does not affect any statutory consumer rights regarding defective or non-conforming products. 12. Incorrect Delivery Information Customers are responsible for providing complete and accurate delivery information. LA GRECQUE SARL-S shall not be responsible for delays or additional costs caused by: incorrect addresses; incomplete information; inability to contact the Customer; or failed delivery attempts resulting from Customer actions. 13. Returns and Withdrawal Rights Consumers benefit from statutory rights under Luxembourg and European Union consumer protection legislation. Detailed information regarding: the 14-day withdrawal period where applicable; excluded products; return conditions; damaged goods; refunds; and replacement procedures is available in our Returns & Right of Withdrawal Policy . Food products that are sealed and unsuitable for return for health or hygiene reasons once opened may be excluded from withdrawal rights in accordance with applicable legislation. 14. Legal Guarantee of Conformity Consumers benefit from statutory guarantees relating to goods that do not conform with the sales contract. Where products are defective, incorrectly described or otherwise non-conforming, Customers may benefit from remedies provided by applicable Luxembourg law. Nothing in these Terms excludes or limits mandatory consumer rights. 15. Liability LA GRECQUE SARL-S shall be responsible for obligations imposed upon it by applicable law. To the maximum extent permitted by law, LA GRECQUE SARL-S shall not be liable for indirect or consequential losses, including: loss of profit; loss of business; loss of opportunity; loss of anticipated savings; or commercial interruption. LA GRECQUE SARL-S shall not be responsible for damage caused by: improper storage after delivery; misuse of products; failure to follow instructions; normal deterioration of perishable products; or circumstances beyond our reasonable control. Nothing in these Terms excludes liability where such exclusion is prohibited by law, including liability for personal injury caused by negligence, fraud or other mandatory liabilities. 16. Force Majeure LA GRECQUE SARL-S shall not be liable for delays or failures caused by events outside its reasonable control, including: natural disasters; severe weather; strikes; transport interruptions; supplier failures; governmental restrictions; pandemics; technical failures; or other unforeseen events. Where such circumstances occur, LA GRECQUE SARL-S may suspend performance until normal operations can resume. 17. Intellectual Property All website content, including: text; images; logos; graphics; designs; product descriptions; and trademarks belongs to LA GRECQUE SARL-S or is used with permission. No content may be copied, reproduced, distributed or commercially used without prior written permission. 18. Governing Law and Jurisdiction These Terms are governed by the laws of the Grand Duchy of Luxembourg. Any dispute relating to these Terms shall be subject to the competent courts of Luxembourg, without prejudice to mandatory consumer rights granted under applicable law. 19.
